Terms of Service and User Agreement for Health Insurance Enrollment Assistance

Introduction

Welcome to our health insurance enrollment platform. By using our services, you agree to the following terms and conditions. Please read them carefully.

Eligibility

You must be at least 18 years of age or a legally emancipated minor to use this Service. By agreeing to these terms, you represent and warrant that you meet these eligibility requirements.

Non-Government Affiliation

Our platform is independent and not affiliated with any government agencies. We facilitate the enrollment process for health insurance through Nevada Health Link.

Account Creation and Responsibility

To use our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Privacy Policy and Consent to Use Data

Your privacy is crucial to us. Our Privacy Policy outlines how we collect, use, and protect your information. By using our service, you consent to data collection and use as set forth in our Privacy Policy and agree to the sharing of your information with Nevada Health Link and insurers as required to process your insurance enrollment.

Accuracy of Information

You agree to provide accurate and current information about yourself as prompted by our service's registration forms. Misrepresentation may result in denial of service and termination of this agreement.

Electronic Communications and Signatures

When you use our services or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically and agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Your use of electronic signatures to sign any documents legally binds you as if you had signed on paper.

Limitation of Liability

While we strive to provide accurate and timely information, the service may contain inaccuracies, outdated information, or typographical errors. We shall not be liable for any information provided on this service. Our liability for any claim arising from your use of our services shall not exceed the amount you paid for the services.

Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT

Our goal is to resolve disputes fairly and quickly. Accordingly, you and Will Mountford agree to resolve any claim, dispute, or controversy that arises out of this Agreement or the Service provided in connection with this Agreement through binding arbitration. The arbitration shall be held on a confidential basis before one commercial arbitrator with substantial experience in resolving commercial contract disputes from the American Arbitration Association ("AAA"). As modified by this Agreement, and unless otherwise agreed upon by the parties in writing, the arbitration will be governed by the AAA's Commercial Arbitration Rules and, if the arbitrator deems them applicable, the Supplementary Procedures for Consumer Related Disputes. You agree that the arbitration shall take place in the state of Nevada and that the laws of the State of Nevada will apply to any disputes or claims that belong in arbitration. Furthermore, except as provided by AAA Rules or as otherwise provided for in this Agreement, you and Will Mountford will not disclose the existence, content or results of any arbitration hereunder without the prior written consent of both parties. The arbitrator will have no authority to award punitive or other damages not measured by the prevailing party's actual damages, except as may be required by statute.

A party who wishes to start arbitration must submit a written Demand for Arbitration to AAA and give notice to the other party as specified in the AAA Rules. You can find forms and instructions for initiating arbitration at www.adr.org.

By agreeing to this arbitration provision, you understand that you and Will Mountford waive the right to sue in court and have a jury trial. You and Will Mountford both waive the right to participate in a class action or class-wide arbitration for any claims covered by this agreement to arbitrate. If any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal, or otherwise conflicts with the AAA Rules, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein.

Changes to the Terms

We reserve the right, at our discretion, to modify these Terms at any time. Your continued use of the service after any such changes indicates your acceptance of the new Terms.

Termination

We may terminate or suspend your access to our service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Governing Law

These Terms are governed by the laws of the state of Nevada without regard to its conflict of law provisions.
